These Terms & Conditions (“Terms”) govern your access to and use of Lumina (the “App”), owned and operated by Epiphyte Gens LLC, a company registered in Miami, Florida, USA.

By using the App, you agree to these Terms. If you do not agree, please do not use Lumina.

1. Use of the App

  • You must be at least 13 years old (or the minimum age of digital consent in your region) to use Lumina.
  • You agree to use Lumina only for lawful, personal, and non-commercial purposes.
  • You are solely responsible for the content (including text, images, and audio) you upload, record, or submit within the App.
  • You agree not to use Lumina in any way that violates applicable laws or infringes the rights of others.

2. Emotional-Wellness Disclaimer

  • Lumina provides journaling tools, voice reflections, and AI-generated insights for informational and self-development purposes only.
  • Lumina is not a medical, therapeutic, or psychological service.
  • The App’s AI responses do not replace professional counseling, diagnosis, or treatment.
  • Always seek guidance from a qualified healthcare or mental-health professional regarding emotional, psychological, or medical concerns.

If you ever feel in danger or in crisis, contact local emergency services or a mental-health hotline immediately.

3. No Responsibility for User Actions

  • Lumina and Epiphyte Gens LLC are not responsible for any decisions, behaviors, or actions you take as a result of your use of the App, its AI-generated content, reflections, or interactions.
  • You acknowledge that all insights, prompts, or emotional interpretations provided by Lumina are automatically generated and are intended only for personal reflection and well-being support.
  • You use the App entirely at your own discretion and assume full responsibility for your actions and outcomes resulting from your use of Lumina.

4. Intellectual Property

  • All design elements, text, graphics, software, and content within Lumina (except for your personal entries and uploaded material) are the property of Epiphyte Gens LLC and are protected under copyright and intellectual property laws.
  • You retain ownership of your journal entries, photos, and voice recordings.
    By using Lumina, you grant Epiphyte Gens LLC a non-exclusive, worldwide, royalty-free license to store, process, and analyze your content solely to operate, improve, and personalize the App and its AI systems.
  • You may not reproduce, distribute, or exploit any part of Lumina without prior written authorization.

5. Authentication and Accounts

  • You may create or access your account using Google Sign-In, Sign in with Apple, or other authentication methods provided by Lumina.
  • By using these services, you authorize Lumina to access the basic account details you approve (e.g., name, email address, profile image).
  • You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
  • Notify us immediately at lumina.support@epiphytegens.com if you suspect unauthorized use of your account.

6. Prohibited Activities

You agree not to:

  • Upload, record, or submit content that is unlawful, offensive, defamatory, harmful, or promotes hate, self-harm, or violence.
  • Use Lumina to harass, exploit, or spread misinformation.
  • Reverse-engineer, decompile, or attempt to access the App’s software, databases, or AI systems.
  • Interfere with Lumina’s security, functionality, or network operations.
  • Use another person’s account or data without authorization.

Violation of these rules may result in suspension or termination of your access to Lumina.

7. Termination

We may suspend or terminate your access to Lumina, with or without notice, if:

  • You violate these Terms,
  • You misuse or abuse the App, or
  • We are required to do so by law.

Upon termination, your right to use Lumina ceases immediately. You may request deletion of your account and associated data under our Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Epiphyte Gens LLC, its affiliates, employees, and partners are not liable for any harm, loss, emotional distress, injury, or damages arising from your use or inability to use Lumina.
  • The App is provided “as is” and “as available”, without warranties of any kind, express or implied.
  • We make no guarantees that Lumina will be uninterrupted, error-free, or secure.
  • You assume full responsibility for how you use the App and for any consequences of your actions while using it.

9. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
Any disputes or claims shall be handled exclusively in the courts located in Miami-Dade County, Florida.

10. Changes to These Terms

We may update or modify these Terms at any time.
Updates will be posted within the App and/or on our website.
Continued use of Lumina after any modification means you accept the revised Terms.
